SENATE BILL NO. 2138- Special hunting permits

  • A BILL for an Act to amend and reenact subsection 10 of section 20.1-02-05 of the North Dakota Century Code, relating to allowing advanced practice registered nurses to verify the physical conditions necessary for special hunting permits to be issued to individuals to shoot from stationary motor vehicles.

  • NDNPA testified in favor January 17th –Senate Energy and Natural Resources

  • Amended to include PA.

  • January 23rd passed Senate 47-0, sent to the House.

  • Introduced, first reading, referred to House Energy and Natural Resources Committee

  • Committee hearing 2/28/2019 2:pm House Energy and Natural Resources Committee NDNPA did testify in favor

  • There will be discussion this week to compare this bill with the crossbow

  • Courtney Short did check with committee aid and this should come out of committee today or soon.

SENATE BILL NO. 2184- Definition of allied health care professional and health care provider with respect to workers' compensation claims and benefits. A BILL for an Act to amend and reenact subsection 7 of section 23-07.5-02, sections 65-01-02, 65-01-11, 65-01-15, 65-02-20, 65-02-21.1, 65-05-07, 65-05-08.1, and 65-05-08.3, subsections 5 and 12 of section 65-05-12.2, section 65-05-28, subsection 2 of section 65-05-29, section 65-05-30, subsection 3 of section 65-05-32, subsection 5 of section 65-05.1-01, subsection 6 of section 65-05.1-02, and subsection 1 of section 65-07-03 of the North Dakota Century Code, relating to the definition of allied health care professional and health care provider with respect to workers'compensation claims and benefits.

  • NDNPA did testify in support on January 23rd 9:15am – Senate Industry, Business, and Labor. Out of committee do pass.

  • January 24th passed Senate 47-0, sent to the House.

HOUSE BILL NO.1126-Admission of residents to basic care facility and remain while on hospice.

  • A BILL for an Act to amend and reenact section 23-09.3-08.1 of the North Dakota Century Code, relating to basic care facility end-of-life services

  • Sent to House Human Services Committee- Hearing scheduled for January 30th 9:15 am. NDNPA will testify in support.

  • 2/7/2019 to the Senate- the State Department of health does not like the bill, they called me last Friday, I had them set up a meeting with hospice, Shelly Peterson from LTC, and basic care facilities. We met for over an hour on 2/11/2019. Trying to change working so the department of health will support.

HOUSE BILL NO.1509-Paid family medical leave

  • A BILL for an Act to create and enact chapter 65-05.3 of the North Dakota Century Code, relating to a paid family medical leave program; to provide an appropriation; and to provide for a transfer.

  • Referred to House Industry, Business, and Labor. Will testify January 28th at 2:30pm

  • Out of committee do not pass 9-3-2 place on calendar

  • 2/5/2019 failed the House 17 yeas/ 75 nays

HOUSE BILL NO.1456-Compensable Injury

  • A BILL for an Act to create and enact a new section to chapter 65-01, a new section to chapter 65-05, a new section to chapter 65-06, and a new section to chapter 65-10 of the North Dakota Century Code, relating to presumption of the treating physician, presumption of compensability, and disputing the denial of a claim; and to amend and reenact subsection 10 of section 65-01-02, and sections 65-06-03, 65-10-01, and 65-10-03 of the North Dakota Century Code, relating to the definition of a compensable injury, how compensation benefits are determined, and the cost of an appeal.

  • Will recommend changing physician to health care provider.

  • Referred to House Business, Industry, and Labor. Hearing schedule for January 29th at 8:00am.

  • Spoke to Tim Wahlin, we do not need to testify. The language change will take care of itself because of changes made in SB 2184.

SENATE BILL NO.2233- Infertility care and cancer preservation

  • A BILL for an Act to create and enact a new section to chapter 26.1-36 and a new section to chapter 54-52.1 of the North Dakota Century Code, relating to health insurance coverage for infertility treatment; and to provide for application.

  • NDNPA did testify in favor January 22nd 10:30am – Senate Industry, Business, and Labor.

  • Cost analysis refused by Employee Benefits Committee. Will be sent back to Senate Industry, Business, and Labor committee. Communication has been made with chairman to keep bill moving forward.

HOUSE BILL NO. 1508-Common process for applying to nursing programs

  • A BILL for an Act to create and enact a new section to chapter 15-10 of the North Dakota Century Code, relating to a common process for applying to nursing programs at state institutions of higher education.

  • Was heard in committee January 21st at 3:30pm – House Education

  • Reported back, do not pass, placed on calendar 8-6-0

HOUSE BILL NO.1063- Opioid therapy, benzodiazepine, and muscle relaxant duration limits - Termination of coverage.

  • A BILL for an Act to create and enact section 65-05-40 of the North Dakota Century Code, relating to duration limits for opioid therapy, benzodiazepine, and muscle relaxants; and to provide for application.

  • Was heard in committee January 22nd 8:00am- House Business, Industry, and Labor.

  • Section 3 on this bill was removed which improved the outlook from pain management.

  • Nora Allen FNP from pain management at Sanford did send in testimony against this bill.

SCR 4018

  • A concurrent resolution requesting the Legislative Management to consider studying the feasibility and desirability of implementing a paid family leave program structured to be beneficial to both families and businesses, including an analysis of how to make the program financially sound while being affordable for families and businesses; and a review of the data on usage rates from other states that have programs, which state agency would be best suited to administer the program, and policies required to ensure program success. WHEREAS, the United States Family and Medical Leave Act guarantees twelve

  • Legislative study for feasibility and desirability of implementing a paid family leave program

SENATE BILL NO. 2353-Relating to uniform regulation of occupations and professions

  • A BILL for an Act to create and enact chapter 43-63 of the North Dakota Century Code, relating to uniform regulation of occupations and professions; to amend and reenact subsection 4 of section 54-10-01 and section 54-10-27 of the North Dakota Century Code, relating to duties of the state auditor; to provide a penalty; to provide for a legislative management study; and to provide an effective date.

  • Referred to Senate Government and Veterans Affairs committee. Hearing was January 31st at 2:30pm. NDNPA did testify in opposition with an amendment to exclude nursing. This bill was sponsored by Senator J. Lee. Did speak with Senator Lee after the testimony, is concern there may be conflict with APRN compact. Much discuss and changes to come.
